Legal Aid Mediation: Eligibility 2025

From Legal Aid Agency & Gov.uk:

  • Income threshold: Under £2,657/month gross (or £733 disposable)
  • Capital threshold: Under £8,000 (some exceptions)
  • Passporting benefits: Universal Credit, Income Support, JSA, ESA
  • Domestic abuse: Automatic eligibility with evidence
  • Both parties covered if one qualifies (MIAM only)
  • FREE mediation - MIAM and full sessions at no cost

Legal aid makes mediation free for those who need it most.

Legal aid mediation provides free family mediation funded by the government for people who cannot afford to pay privately. If you qualify, your entire mediation journey - including the MIAM and all subsequent sessions - is completely free with no contributions required.

Official Eligibility Thresholds (April 2025)

Key Figures from Gov.uk Civil Legal Aid Means Testing:

  • Gross monthly income: £2,657 or less (+ £222 per child beyond 4 dependants)
  • Disposable monthly income: £733 or less
  • Disposable capital: £8,000 or less
  • No contributions required for family mediation (unlike other legal aid)
  • Both parties get free MIAM if one qualifies (since May 2016)
  • Domestic abuse: All income/capital limits waived

What is Legal Aid Mediation?

Legal aid mediation is family mediation funded by the Legal Aid Agency (LAA), an executive agency of the Ministry of Justice. It helps separating couples resolve disputes without going to court, covering:

  • Child arrangements - Where children live, contact schedules, holiday arrangements
  • Financial matters - Division of assets, property, pensions, maintenance
  • Property disputes - Family home, jointly owned assets

Unlike other forms of legal aid, clients do not make contributions for family mediation cases according to the LAA Family Mediation Guidance Manual (September 2024). If you qualify, everything is free.

Who Qualifies for Legal Aid Mediation?

Eligibility is assessed on financial circumstances OR domestic abuse evidence. You must pass both income AND capital tests (unless receiving passporting benefits or claiming domestic abuse exemption).

Financial Eligibility Thresholds

According to Keycard 61 (April 2025) from Gov.uk:

Passporting Benefits (Automatic Income Qualification)

If you receive any of these benefits, you automatically pass the income test per Gov.uk guidance:

  • Universal Credit (income-based element)
  • Income Support
  • Income-based Jobseekers Allowance (JSA)
  • Income-related Employment and Support Allowance (ESA)
  • Guarantee Credit element of Pension Credit

Important

Capital test still applies: Even if you receive passporting benefits and automatically qualify on income, the LAA must still assess your capital. You must have £8,000 or less in disposable capital to qualify.

Domestic Abuse Exemption

If you have experienced domestic abuse from the other party, all upper eligibility limits are waived according to Practice Direction 3A. You qualify regardless of income or capital.

Acceptable evidence includes:

  • Non-molestation order, occupation order, or restraining order
  • Police arrest, caution, or conviction for domestic abuse
  • Ongoing criminal proceedings for domestic abuse offence
  • Letter from GP or health professional confirming injuries
  • MARAC (Multi-Agency Risk Assessment Conference) referral
  • Letter from IDVA (Independent Domestic Violence Advisor)
  • Letter from domestic abuse support organisation (operating 6+ months)
  • Letter confirming refuge stay or refusal due to capacity
  • Home Office confirmation of domestic abuse victim immigration status

Evidence must generally be from the last 5 years.

How to Apply for Legal Aid Mediation

Check Your Eligibility

Use the Gov.uk Legal Aid Eligibility Calculator to get an initial indication of whether you qualify. This is preliminary - final assessment is done by your mediator.

Find a Legal Aid Mediator

Search the FMC Find a Mediator Directory and filter for "Legal Aid". Mediators must hold FMC Accreditation (FMCA) AND have an LAA contract to provide legal aid mediation.

Gather Your Documents

You will need evidence of your financial situation:

  • Income: Payslips (last 3 months), benefit award letters, tax returns if self-employed
  • Capital: Bank statements, savings accounts, investment valuations
  • If claiming DA exemption: Police reports, court orders, support letters

Attend Your MIAM

At your first appointment, the mediator will help you complete the legal aid application. The LAA typically processes applications within 1-2 weeks.

Attend Free Mediation Sessions

Once approved, your MIAM and all subsequent mediation sessions are completely free with no contributions required.

MIAM Funding Rule: Both Parties Covered

Since 30 May 2016, important MIAM funding rules apply according to the Family Mediation Council:

"As long as one party is financially eligible for a legally-aided MIAM, then both parties will be entitled to a legally-aided MIAM, regardless of the order in which they are seen."

This means:

  • If YOU qualify for legal aid but your ex-partner does not, both MIAMs are free
  • If your ex-partner attends first and qualifies, your MIAM becomes free too
  • The order of attendance does not matter

Two funding options exist for mediation. Here is how they compare:

Recommendation: If you might qualify for legal aid, check this first as it provides more comprehensive coverage than the voucher scheme.

2025 Legal Aid Expansion (Coming Soon)

The UK Government announced historic increases to civil legal aid eligibility in 2024-2025:

  • Income threshold increase to £34,950 annual gross income (up from ~£31,884)
  • Approximately 6 million more people will become eligible
  • This is the first significant increase in almost 30 years

Finding a Legal Aid Mediator

To provide legally-aided mediation, mediators must:

  1. Hold FMC Accreditation (FMCA) from the Family Mediation Council
  2. Have an LAA contract from the Legal Aid Agency
  3. Meet the Mediation Quality Mark (MQM) standards

Disposable Income Calculation

If you do not receive passporting benefits, the LAA calculates your disposable income by deducting allowable expenses from your gross income:

Allowable deductions include:

  • Income tax and National Insurance
  • Housing costs (rent/mortgage)
  • Childcare costs
  • Maintenance paid to ex-partner
  • Criminal legal aid contributions (if applicable)

Your disposable income must be £733 or less per month to qualify.
