FMC Position on Remote MIAMs

From Family Mediation Council:

  • Remote/online MIAMs have full legal validity under FPR Practice Direction 3A
  • No distinction in court between online and in-person MIAM certificates
  • Mediator must verify participant identity via video
  • Certificate delivered electronically (PDF) has same standing as paper
  • 4-month validity applies equally to digital certificates

"Online MIAMs became standard practice during COVID-19 and remain a fully compliant option."

What is an Online MIAM?

An online MIAM (Mediation Information Assessment Meeting) is a video call appointment with an FMC-accredited mediator. It serves the same purpose as an in-person MIAM - to assess whether mediation is suitable for your family dispute and provide you with a valid MIAM certificate for court.

Online video call mediation session

Since 2020, online MIAMs have become increasingly popular and are now offered by most FMC-accredited mediators across the UK. The process is identical to an in-person MIAM, just conducted via secure video conferencing.

Benefits of an Online MIAM

Choosing an online MIAM offers several advantages:

  • Convenience - Attend from home, work, or anywhere with internet
  • No travel - Save time and money on transport
  • Wider choice - Access mediators nationwide, not just local ones
  • Faster booking - Often more appointment slots available
  • Same validity - Your digital MIAM certificate is fully legal
  • Privacy - Attend discreetly from a private location
  • Accessibility - Easier for those with mobility issues or caring responsibilities

How Online MIAMs Work

1

Book Your Online MIAM

Contact an FMC-accredited mediator who offers online MIAM appointments. Many can offer same-day or next-day availability.

2

Receive Your Video Link

You will receive a secure video conferencing link (usually Zoom, Teams, or a dedicated platform) along with joining instructions.

3

Attend Your Online MIAM

Join the video call at your appointment time. The mediator will explain the mediation process, discuss your situation, and assess suitability.

4

Receive Your Digital MIAM Certificate

After your online MIAM, you will receive your MIAM certificate (FM1 form) by email - usually the same day or within 24 hours.

Is an Online MIAM Certificate Valid?

Yes, absolutely. A digital MIAM certificate obtained through an online MIAM has exactly the same legal validity as one from an in-person appointment. The Family Mediation Council confirms that online MIAMs meet all legal requirements.

Your certificate will:

  • Be signed by an FMC-accredited mediator
  • Include all required information for the C100 form
  • Be valid for 4 months from issue
  • Be accepted by all family courts in England and Wales

Finding an Online MIAM Provider

To book an online MIAM, search for mediators offering video appointments:

  2. They offer online MIAM appointments
  3. How you will receive your digital MIAM certificate
  4. Whether legal aid is available if you qualify

Common Questions About Online MIAMs

Can I do a MIAM online?

Yes, online MIAMs are fully valid and widely available. You can attend via video call from home and receive the same legally-valid MIAM certificate as an in-person appointment.

How quickly can I get an online MIAM?

Many mediators offer same-day or next-day online MIAM appointments. Because you are not limited by location, you can often find faster availability than with in-person appointments.

Is an online MIAM certificate accepted by courts?

Yes, a digital MIAM certificate from an online MIAM is fully accepted by all family courts. There is no difference in legal validity between online and in-person certificates.

What if I have technical problems during my online MIAM?

If you experience technical issues, contact your mediator immediately. Most will reschedule at no extra cost or continue the appointment by phone if needed.

Can both parties attend the same online MIAM?

No, MIAMs are individual appointments. Each party attends separately (at different times) to discuss their situation privately with the mediator.
