MIAM · when time matters

Urgent MIAM: your options when time matters

An urgent MIAM is an ordinary MIAM booked quickly: court guidance says a MIAM should be held within 15 business days of contacting the mediator[1]. To book a MIAM, contact authorised mediators on the FMC register[2]. If even that is too long because of a risk to safety or of a child being taken abroad, the rules have an urgency exemption[3].

Why no one can promise a same-day certificate

The MIAM confirmation is signed by an authorised family mediator after you have attended[7][8]. The FMC's guidance says court forms should be signed only once a MIAM has taken place[9], and the meeting itself usually takes 45–60 minutes[4].

02/ Booking

How to book a MIAM quickly

  1. Search the Family Mediation Council register and tick Qualified to sign court forms[2].
  2. Tick Offers online mediation too: a MIAM by video is allowed, so you are not limited to your area[10][2].
  3. Widen the distance if the list is short[11].
  4. Contact several mediators at once, say you have a deadline, and ask when they can see you. Court guidance says a MIAM should be held within 15 business days of contact[1].
  5. Have the other parent's contact details ready; the mediator will use them to invite them to a MIAM[12].
  6. Ask about cost when you call: rates vary by provider[13]. If you may qualify for legal aid, ask about that too[14].

Keep a note of each mediator you contact and the date. If every authorised mediator within 15 miles (or five of them) says they cannot see you within 15 business days, and you cannot attend online, you can claim an exemption by giving the court those details[15].

03/ The exemption

The urgency exemption

You do not need a MIAM if the application must be made urgently because[3]:

  • there is a risk to the life, liberty or physical safety of you, your family or your home;
  • delay caused by attending a MIAM would cause a risk of harm to a child, or a risk of a child being unlawfully taken out of the UK or kept abroad;
  • delay would cause a significant risk of a miscarriage of justice, significant financial hardship to you, or irretrievable problems with the dispute, such as the loss of important evidence;
  • there is a significant risk that court proceedings will be started first in another country[3].

Wanting an earlier court date is not on this list[3]. You claim the exemption on the application form; the court issues the case but checks the exemption, and can direct you to a MIAM and pause the case if it is not valid[16][17].

04/ Without notice

Applying without notice

A MIAM is also not required if your application will be made without notice, meaning the court hears it before the other parent is told[18]. On Form C100 you give your reasons for asking for a without-notice hearing, and the court will not hold one without reasons[5].

05/ Urgent hearings

Asking the court for an urgent hearing

Form C100 has a section for asking for an urgent hearing[5]. You set out the order you want, why it is urgent, how quickly it should be considered, and what you have done to tell the other parent[5].

An immediate risk of harm to you or your child is an example of when an urgent hearing is needed; otherwise, in many cases the first hearing takes place within 2 months[5]. The court decides whether your case needs an urgent hearing[5]. See Form C100, and prohibited steps orders if you are worried a child will be taken away.

If you need protection now

If you have been a victim of domestic abuse, you can apply for an injunction: a non-molestation order, which protects you or your child from being harmed or threatened, or an occupation order, which decides who can live in the family home[6]. There is no fee to apply[6].

If you need protection immediately, you can ask for an emergency order without telling the other person first[6]. The court holds a hearing, and an emergency order usually lasts until the full hearing[6].

Which providers offer the fastest MIAM appointments?

We do not rank or recommend providers, and we know of no official source that compares mediators by how soon they can see you. The FMC register shows who is authorised and filters for court forms, legal aid and online mediation; it does not show waiting times[2].

What helps: include mediators who offer online MIAMs[2], widen the search distance[11], and ask each mediator directly. Court guidance expects a MIAM within 15 business days of contact[1].
