Safeguarding Framework
From Judiciary Guide to Family Mediation 2024:
- Mediators are trained in screening for domestic abuse and coercive control
- Shuttle mediation allows discussions to continue without direct interaction
- Sessions can use separate physical rooms or online "breakout rooms"
- "Hybrid" or "lawyer-assisted" mediation includes legal support
- Mediation must be "safeguarding-led" where abuse is alleged
What is Shuttle Mediation?
Shuttle mediation (also called indirect mediation) is a form of family mediation where the two parties are placed in separate rooms and the mediator moves between them. The parties never meet face-to-face during the process.
The mediator carries proposals, questions, and responses between the rooms, facilitating negotiation without direct contact. Everything said by each party remains confidential unless they give permission to share it with the other.
Shuttle mediation achieves the same outcomes as face-to-face mediation - agreements about children, finances, and living arrangements - without requiring the parties to be in each other's presence.
When is Shuttle Mediation Used?
Shuttle mediation is appropriate when:
- Domestic abuse - Where there has been physical, emotional, or coercive control (and mediation is still assessed as suitable)
- High conflict - Where face-to-face communication consistently leads to arguments or breakdown
- Power imbalance - Where one party feels intimidated or unable to express themselves in the other's presence
- Anxiety or fear - Where one party experiences significant anxiety about being in the same room
- Restraining orders - Where a non-molestation order prevents direct contact
- Recent separation - Where emotions are still very raw
Domestic abuse and mediation
If you have experienced domestic abuse, you may be exempt from attending a MIAM. However, some victims choose to mediate using shuttle mediation as it allows them to negotiate without facing their abuser. The mediator assesses suitability carefully.
How Does Shuttle Mediation Work?
Separate MIAMs
Each party attends a MIAM individually. The mediator assesses suitability for shuttle mediation and discusses each party's concerns.
Arrival and Setup
On the day of mediation, parties arrive at different times or use different entrances. Each is shown to a separate room.
Opening
The mediator visits each room to explain the process, set ground rules, and understand each party's priorities and concerns.
Shuttling
The mediator moves between rooms, sharing proposals, exploring options, and reality-testing positions. They do not take sides.
Building Agreement
Through multiple rounds of shuttling, the mediator helps narrow the gap between positions and find common ground.
Recording the Agreement
Once terms are agreed, the mediator prepares a Memorandum of Understanding. Both parties review it separately.
Shuttle Mediation vs Face-to-Face Mediation
| | Face-to-Face | Shuttle | Online/Video | |---|------------|---------|-------------| | Format | Same room | Separate rooms | Separate video calls | | Communication | Direct | Via mediator | Via mediator | | Body language | Visible | Not visible | Partially visible | | Session length | 90 mins | 2-3 hours | 90 mins | | Best for | Low-moderate conflict | High conflict/abuse | Distance/convenience | | Cost | Standard | Same or slightly more | Standard |
Pros of Shuttle Mediation
- Safety - no direct contact with the other party
- Easier to express yourself without intimidation
- Mediator can reality-test each position privately
- Less emotionally charged than face-to-face
- Still produces legally valid agreements
Cons of Shuttle Mediation
- Sessions take longer (typically 2-3 hours vs 90 mins)
- Can feel slower or less productive
- Misunderstandings are more likely without direct dialogue
- May require more sessions overall
- Harder to build mutual understanding
How Much Does Shuttle Mediation Cost?
| Item | Cost | |------|------| | MIAM (per person) | £90-£150 | | Shuttle mediation session | £120-£250 per person | | Total (3-5 sessions) | £500-£2,000 per person | | With voucher scheme | £200-£1,500 per person |
Shuttle mediation is typically the same price as face-to-face per session, though some mediators charge slightly more because sessions take longer. The Family Mediation Voucher Scheme can still be used.
Is Shuttle Mediation Right for You?
Choose shuttle mediation if:
- You feel unsafe being in the same room as the other party
- Previous face-to-face attempts have broken down
- There is a history of domestic abuse or coercive control
- You experience severe anxiety about direct contact
- A court order prevents direct contact
Consider face-to-face mediation if:
- You can communicate calmly with the other party
- There is no safety concern
- You want to practice direct communication for future co-parenting
- You prefer a quicker process
Consider online mediation if:
- You live far apart
- Childcare makes in-person attendance difficult
- You want the convenience of video
- You feel safe with video contact but not physical proximity
Shuttle Mediation and Domestic Abuse
Mediation (including shuttle) is not appropriate in all domestic abuse cases. The mediator must carefully assess:
- Whether the victim can participate freely and safely
- Whether the abuser will use the process to continue control
- Whether the power imbalance is too great for fair negotiation
- Whether there are ongoing safety risks
If mediation is assessed as unsuitable, the mediator will issue a MIAM certificate confirming this, allowing you to apply to court using the C100 form.
Frequently Asked Questions
Can shuttle mediation be done online?
Yes. Many mediators offer online shuttle mediation where each party is on a separate video call. The mediator switches between calls or uses breakout rooms. This combines the safety of shuttle mediation with the convenience of video.
How many sessions does shuttle mediation usually take?
Typically 3-5 sessions, the same as face-to-face mediation. However, because each session is longer (2-3 hours vs 90 minutes) and communication is indirect, some cases require additional sessions.
Can I bring a support person to shuttle mediation?
Some mediators allow a support person (friend, family member, or support worker) to sit with you in your room. They cannot participate in the mediation but can provide emotional support. Ask your mediator in advance.
Will the other party know where I am during shuttle mediation?
The mediator arranges for parties to arrive at different times or use different entrances. Your room location is not disclosed to the other party. Your safety is the mediator's priority.
Is the agreement from shuttle mediation legally binding?
Like all mediation, the agreement itself is not legally binding. However, it can be made into a legally binding consent order by the court. This is the recommended next step after reaching agreement.
