What is Shuttle Mediation?

Shuttle mediation (also called indirect mediation) is a form of family mediation where the two parties are placed in separate rooms and the mediator moves between them. The parties never meet face-to-face during the process.

The mediator carries proposals, questions, and responses between the rooms, facilitating negotiation without direct contact. Everything said by each party remains confidential unless they give permission to share it with the other.

Shuttle mediation achieves the same outcomes as face-to-face mediation - agreements about children, finances, and living arrangements - without requiring the parties to be in each other's presence.

When is Shuttle Mediation Used?

Shuttle mediation is appropriate when:

  • Domestic abuse - Where there has been physical, emotional, or coercive control (and mediation is still assessed as suitable)
  • High conflict - Where face-to-face communication consistently leads to arguments or breakdown
  • Power imbalance - Where one party feels intimidated or unable to express themselves in the other's presence
  • Anxiety or fear - Where one party experiences significant anxiety about being in the same room
  • Restraining orders - Where a non-molestation order prevents direct contact
  • Recent separation - Where emotions are still very raw

If you have experienced domestic abuse, you may be exempt from attending a MIAM. However, some victims choose to mediate using shuttle mediation as it allows them to negotiate without facing their abuser. The mediator assesses suitability carefully.

How Does Shuttle Mediation Work?

Separate MIAMs

Each party attends a MIAM individually. The mediator assesses suitability for shuttle mediation and discusses each party's concerns.

Arrival and Setup

On the day of mediation, parties arrive at different times or use different entrances. Each is shown to a separate room.

The mediator visits each room to explain the process, set ground rules, and understand each party's priorities and concerns.

Shuttling

The mediator moves between rooms, sharing proposals, exploring options, and reality-testing positions. They do not take sides.

Building Agreement

Through multiple rounds of shuttling, the mediator helps narrow the gap between positions and find common ground.

Recording the Agreement

Once terms are agreed, the mediator prepares a Memorandum of Understanding. Both parties review it separately.

Is Shuttle Mediation Right for You?

Choose shuttle mediation if:

Shuttle Mediation and Domestic Abuse

Mediation (including shuttle) is not appropriate in all domestic abuse cases. The mediator must carefully assess:

  • Whether the victim can participate freely and safely
  • Whether the abuser will use the process to continue control
  • Whether the power imbalance is too great for fair negotiation
  • Whether there are ongoing safety risks

If mediation is assessed as unsuitable, the mediator will issue a MIAM certificate confirming this, allowing you to apply to court using the C100 form.

Yes. Many mediators offer online shuttle mediation where each party is on a separate video call. The mediator switches between calls or uses breakout rooms. This combines the safety of shuttle mediation with the convenience of video.
